This Privacy Policy applies to all users of the Provider's services, insofar as personal data is processed as a result of these services. In particular, this includes customers who have entered into a contract with the Provider for the Provider's services, its employees, and website visitors. This Privacy Policy is designed to meet the requirements of the Swiss Federal Act on Data Protection («FADP») and the EU General Data Protection Regulation («GDPR»). However, whether and to what extent these laws are applicable depends on the individual case in question.
We primarily process the personal data that we receive from our customers and other business partners in the context of our business relationships with such parties, as well as other persons involved in them, or that we collect from the users of our websites, apps, and other applications when they operate these services.
Where permitted, we also extract certain data from publicly accessible sources or receive such data from other companies, from authorities and other third parties. If customers visit the Provider's website outside the area protected by login, the web server technology used automatically logs general technical information about their visit. This includes, among other things, the IP address of the device used, although this is anonymized by Google before being stored, which means it can no longer be associated with the customer. Google uses the _anonymizeIp method for this purpose. It also includes information on the browser type, the Internet service provider, and the operating system used.
During free trial access and when using the MWelt software for a fee within the area protected by login, all data entered or submitted by the customer during the registration process and during use of the software will also be stored. This is particularly the case if the customer registers, carries out orders, fills out online forms, participates in surveys or competitions, corresponds with the Provider online or offline, or comes into contact with the Provider via social media, blogs, or other interactive media.
Upon data collection, the customer consents to the processing, use, and disclosure of personal data within the context and scope of the purposes described in this Privacy Policy.
Customers have the option to share their data with third parties, such as their personal trustee, either directly or through the Provider’s trustee partner program. By granting access rights, the customer consents to the Provider making their personal data available to third parties (e.g., the trustee) or allowing them to access it. The customer retains full control over the access rights granted to third parties and can restrict or revoke access at any time.
In addition, the Provider allows third parties (e.g., trustees) to create their own MWelt account as a customer. In this case, the third party or trustee manages the access rights, which may include granting, restricting, or denying access to third parties. However, the Provider reserves the right to disclose specific data to authorized third parties in justified cases.
The Provider offers its software solutions on a rental basis to customers. The personal data entered by customers into the software during the rental period is stored and processed by the Provider for the purpose of providing the services. This includes customer registration data, service usage information, and any additional data submitted while using the software. By renting the software, the customer consents to the processing and use of this data for the specified purposes.
The customer remains fully responsible for ensuring that any personal data provided to the Provider is correct and that all necessary consents have been obtained for its processing. The customer is also responsible for managing the access rights within the software and can grant, restrict, or revoke access for other users at any time.
At MWelt AG, we primarily use the personal data we collect to fulfill and manage contracts with our customers and business partners. This includes providing access to our software-as-a-service (SaaS) solutions and ensuring the delivery of the products and services our customers require. We also process data to fulfill our legal obligations, both within Switzerland and internationally. If you are a representative of one of our customers or business partners, your personal data may also be processed in connection with the services we provide to the respective organization.
In addition to this primary purpose, we may process personal data in ways that we believe are necessary and appropriate, in compliance with the relevant data protection laws. Specifically, we may process personal data for the following purposes where we (and sometimes third parties) have a legitimate interest in doing so:
• To enhance and develop our software solutions, services, websites, and mobile applications, as well as other platforms where MWelt AG is present.
• To communicate with third parties and respond to their inquiries.
• To analyze and optimize our processes related to customer needs assessment and acquisition, which may involve collecting personal data from publicly available sources for customer acquisition purposes.

For services provided by our EU or Switzerland-based service providers, we ensure they comply with applicable data protection regulations. These service providers may include companies offering IT services, payment transaction processing, printing, billing, debt collection, consulting, marketing, and other areas that support the execution of our contracts.
If personal data is transferred to recipients in countries that do not offer an adequate level of data protection, we ensure that appropriate safeguards are in place to protect your data. If the customer has granted Google the necessary consent, their web and app browsing history is linked to their Google account. This allows Google to show the same personalized advertisements across all devices the customer uses while logged into their Google account.
Google Analytics collects Google-authenticated user IDs, which are temporarily linked to the data collected by Google Analytics to define and create cross-device target groups for advertisement targeting.

MWelt AG also utilizes Google AdWords, an online advertising program provided by Google Inc. This service includes conversion tracking, which allows us to track the effectiveness of our ads.
When a customer clicks on a Google ad, a cookie is placed on their device for conversion tracking purposes. These cookies are small text files stored by the customer’s browser. These cookies expire after 30 days and are not used to personally identify users. If the customer visits our website before the cookie expires, Google and MWelt AG can recognize that the customer clicked on the ad and was redirected to our website.
While MWelt AG receives the total number of users who clicked on an ad and were redirected to the site, no personally identifiable information is shared with us.
Customers can prevent cookies from being stored by adjusting their browser settings. However, MWelt AG would like to point out that disabling cookies may result in limited functionality of some website features. MWelt AG also employs the Facebook Pixel, a tool provided by Facebook Inc. (1601 S. California Ave, Palo Alto, CA 94304, USA). The Facebook Pixel allows us to track visitor behavior after they are redirected to our website from a Facebook ad. This helps us evaluate the effectiveness of Facebook ads, conduct statistical analysis, and optimize future advertising strategies.
The data collected via the Facebook Pixel is anonymized for MWelt AG, meaning we cannot identify specific individuals.
